Mediation

Mediation is now a very commonly used method of dispute resolution. A large number of commercial disputes initiated in the High Court of New Zealand are resolved by mediation and all members of Chambers have experience as mediators and as counsel to parties in mediations. Considerable planning is involved by counsel in mediations. Several members of Bankside Chambers have extensive mediation practices involving domestic and international mediations.

They have been trained by such institutions as LEADR (Australia/New Zealand), AMINZ (New Zealand) and CDR Associates, Boulder Colorado USA, and the Harvard Law School Programme on Mediation.

Members of Chambers offer both 'facilitative' mediation where the mediator assists the parties to a resolution by a structured process and 'evaluative' mediation where the mediator, if requested, offers a view on legal and/or factual issues in the dispute.
