Education Law The Education Act 1989 contains statutory provisions governing the delivery of primary, secondary and tertiary education. This area of law is one where there have, over the years, been many changes of policy which necessitate additions and changes to the laws governing education in New Zealand. For secondary education, disputes may include issues around funding, zoning, discipline and statutory interpretation. For tertiary education the nature of roles of universities, polytechnics and tertiary institutions generally have caused legal problems as well as funding (EFTS grants), financial viability, institutional autonomy and discipline issues. Decision-making by relevant Ministers, departmental officials and others may require review and testing in the Courts. Policy considerations in education may necessitate consideration of other related legislation such as the State Sector Act 1988, Public Finance Act 1989 and the Public Finance (State Sector Management) Act 2004.
