Simon Foote has secured compensation for a client misled as to the critical attributes of a dairy farm in a recently released High Court decision. Justice Heath found that the vendor of the farm near Kaukapakapa had misrepresented important aspects such as average milk solid production, the effective area of the farm, the size of the herd farmed on it, and the use of other leased land to graze the herd. The purchaser received compensation representing much  of the difference between the price paid and the real value of the farm.
