An important Supreme Court competition law case

John Land’s article on the first NZ Supreme Court price fixing decision has now been published in LawTalk. The decision clarifies (and toughens) the test for what amounts to an “arrangement” under the Commerce Act. It also contains guidance on what amounts to a controlling of price. What is required is a controlling of the overall price. Controlling just a component or part of that price will not always be enough.  See full article here
