Damian Chesterman was counsel for Robt. Jones Holdings Ltd in the Supreme Court recently, dealing with a voidable transaction under s 292 Companies Act 1993, Robt. Jones Holdings Ltd v McCullagh [2019] NZSC 86.The Judgment was issued on 9 August 2019 and confirmed that a transaction falls within s 292 even if the payment is made by a third party and does not diminish the assets of the company in liquidation.
