Bio

Will is a commercial litigator. Since coming to the bar his practice has focused largely on property, companies, financial markets, insolvency and trusts.

He continues to accept instructions in other areas. He has a broad experience, over the last 20 years encompassing most types of civil dispute that come before the High Court.  

Before joining Bankside Chambers, Will was a commercial litigation partner at Meredith Connell. He previously practised at the Sydney bar and at Herbert Smith Freehills.  

Will is regarded as an astute legal advisor and litigation strategist, and a highly effective advocate.

McDonald and Ruscoe as liquidators of Satori Holdings Ltd(in liq) & Anor v Island Grace Fiji Ltd (in rec and in liq) & Ors

Acting for liquidators in proceedings to enforce an equitable lien by selling trust assets associated with a Fijian luxury resort.

 

Financial Markets Authority v CBL Corporation Ltd (in liq) & Ors

Acting for the FMA in two proceedings concerning contraventions of the Financial Markets Conduct Act 2013 in the lead up to the collapse of listed insurer CBL.

 

Talley’s Group Ltd & Ors v Television New Zealand Ltd& Anor

Acting for Talley’s in High Court defamation proceedings arising from a series of 1NEWS broadcasts; and on appeal to the Court of Appeal.

The Gama Foundation v Fletcher Steel Ltd

Acting for Fletchers in arbitration and subsequent appeals to the High Court and the Court of Appeal regarding commercial lease obligations.

Parly Assets Ltd v Auckland Council

Acting for Tournament Group in several claims for compensation under the Public Works Act 1981 for compulsory subterranean land acquisition for City Rail Link.

Acted for liquidators of the original Hawkins construction in directors duties litigation.

 

Fuji Xerox New Zealand Ltd & Ors v Whittaker &Ors

Acted for Fuji against its former executives and auditor for negligence and deceit.

Acted for the Crown in defence of damages claim against the Police for unlawful arrest.

Oceania Football Confederation Inc v Nicholas & Ors

Acted for FIFA’s Oceania conference in fiduciary duties litigation against its former officers relating to the construction of the Home of Football facility.

Minister of Education & Ors v Hawkins ConstructionNorth Island Limited & McConnell

Acted for the Crown in construction and non-party costs litigation against directors.
